Who these terms are between

These terms are an agreement between Fleetdy, based in San Antonio, Texas, USA, and the company that opens a Fleetdy account. The Owner who opens the account accepts these terms on the company's behalf. Team members use Fleetdy under their company's account and are covered by it.

The service

Fleetdy is a fleet readiness app: check in and check out, issues and repairs, supplies, maintenance and a readiness board for small vehicle fleets. It is not a routing, scheduling, payment or accounting tool, and it does not replace any vehicle inspection required by law.

Private beta

Access is by invitation after a request we review personally. During the beta we may add, change or remove features, and we may pause access briefly to set a company up or to fix something. The private beta is free. Before paid plans start we will tell each company the price by email at least 30 days ahead, and no company is charged without choosing a plan.

Accounts and roles

The Owner decides who is invited and which role each person has, and is responsible for keeping sign in details private. Tell us about a lost device or an account you believe is compromised and we will end its sessions. Each person may hold one active vehicle session at a time, as the app enforces.

Your data

The records your team enters stay yours. You give Fleetdy permission to store and process them to run the service, as described in the privacy policy. You are responsible for having the right to enter what you enter, including photos of vehicles and of people.

Acceptable use

• Do not try to access another company's data or another person's account.
• Do not probe, scan or overload the service.
• Do not use Fleetdy for anything unlawful.

We may suspend an account that breaks these rules after telling the Owner why.

Plans and billing

There is nothing to pay during the private beta. Paid plans, once they start, are monthly and priced by the size of your fleet, with no contract term. We invoice by email each month, and payment is due within 14 days. If an invoice stays unpaid for 30 days we may pause access until it is settled. A plan change takes effect at the start of the next month. Prices do not change for a company without 30 days notice by email.

Cancellation

Either side can end the account by email with 30 days notice. Within 30 days of cancellation the Owner can ask for an export of the company's records. After that window we delete the company's data, as the privacy policy describes.

Availability and support

We work to keep Fleetdy available at all times, but we do not guarantee uptime during the private beta. Support is by email at hello@fleetdy.com, and we usually answer within a couple of business days.

Disclaimer and limitation of liability

During the beta, Fleetdy is provided as is. Readiness scores, statuses and notices are aids to your own judgment: you remain responsible for your vehicles, your drivers and your compliance with the law.

To the extent the law allows, Fleetdy's total liability for any claim connected to the service is limited to the fees your company paid in the 12 months before the claim, and Fleetdy is not liable for indirect losses such as lost revenue or lost business.

Changes to these terms

Each version of these terms carries its effective date at the top. If we make a material change, we email every account Owner at least 30 days before it applies. Continuing to use Fleetdy after that date means the company accepts the new terms.

Governing law

These terms are governed by the laws of the State of Texas. Any dispute that cannot be settled by talking to us first will be heard by the state or federal courts located in Bexar County, Texas.
